Assault

An assault is defined in Florida Statutes as an intentional, unlawful threat by word or act to do violence to the person of another, coupled with an apparent ability to do so, and doing some act which creates a well-founded fear in such other person that such violence is imminent. It is a second degree misdemeanor punishable by up to 60 days in jail, a fine of up to $500, or both. Other penalties may include probation, community service, or other court-ordered penalties.

Aggravated assault is defined in Florida Statutes as an assault with a deadly weapon without the intent to kill; or an assault with the intent to commit a felony. An aggravated assault is a third degree felony punishable by a term of imprisonment not to exceed five years, a fine up to $5,000, or both. Other penalties may include up to five years of probation, community service, or other court-ordered penalties. The penalties could be further enhanced based on the specific and the defendant’s criminal history.

Battery is defined by Florida Statutes as occurring when a person actually and intentionally touches or strikes another person against the will of the other; or intentionally causes bodily harm to another person. Battery is a misdemeanor of the first degree, punishable by a term of imprisonment not to exceed one year, and a fine up to $1,000, or both. Other penalties may include up to twelve months of probation, community service, or other court-ordered penalties.

Felony battery

A person who has one prior conviction for battery, aggravated battery, or felony battery and who commits any second or subsequent battery commits a felony of the third degree. A felony of the third degree is punishable by a term of imprisonment not to exceed five years, a fine up to $5,000, or both. Other penalties may include up to five years of probation, community service, or other court-ordered penalties.

Aggravated battery is defined by Florida Statutes such that a person commits aggravated battery who, in committing battery Intentionally or knowingly causes great bodily harm, permanent disability, or permanent disfigurement; or who uses a deadly weapon. A person commits aggravated battery if the person who was the victim of the battery was pregnant at the time of the offense and the offender knew or should have known that the victim was pregnant. Aggravated battery is a second degree felony punishable by up to fifteen years imprisonment, up to a $10,000 fine, or both. Other penalties may include up to fifteen years of probation, community service, or other court-ordered penalties. If a firearm was used in the commission of the offense the degree of the felony can be increased further enhancing potential penalties and possibly requiring a mandatory minimum term of imprisonment of ten, twenty, or twenty-five years depending on the facts and circumstances.

Domestic violence as defined by Florida Statutes means any assault, aggravated assault, battery, aggravated battery, sexual assault, sexual battery, stalking, aggravated stalking, kidnapping, false imprisonment, or any criminal offense resulting in physical injury or death of one family or household member by another family or household member.

If a person is adjudicated guilty of a crime of domestic violence, and the person has intentionally caused bodily harm the court is required to order a minimum of 10 days in the county jail for a first offense, 15 days for a second offense, and 20 days for a third or subsequent offense as part of the sentence, unless the court sentences the person to period of incarceration in a state correctional facility. The mandatory jail sentence is increased if the crime was committed in the presence of a family or household member under the age of sixteen.
