Sexual Assault & Sexual Battery Defense in Lake COunty

In Florida, "Sexual Assault" is a term often used in general conversation, but in a courtroom, it is primarily prosecuted as Sexual Battery (F.S. § 794.011). These are some of the most aggressively prosecuted crimes in the state, carrying mandatory minimum prison sentences and a permanent "Sexual Predator" or "Sexual Offender" designation.

At Lewis Defense Law, Attorney Christopher J. Lewis understands that behind every sexual battery allegation is a complex story. As a former sex crimes prosecutor, Attorney Lewis knows how to dissect the State's evidence and protect your life from a devastating conviction.

Lewd and Lascivious crime defense

Sexual Battery Defense

Florida’s sexual battery laws remain among the harshest in the country. Under F.S. § 794.011, sexual battery is defined as the oral, anal, or vaginal penetration by, or union with, a sexual organ or another object without consent.

Whether the allegation involves a stranger or an "acquaintance" (often called "date rape"), the legal consequences in are life-altering.

The Sentencing Reality

Florida law uses a "Point System" for sentencing, but for sexual battery, many charges carry mandatory minimums regardless of your prior record:

Victim Age / Circumstances Felony Classification Typical Penalty Range
Victim Under 12 (Offender 18+) Capital Felony Life Without Parole or Death
Weapon or Serious Injury Used Life Felony Up to Life in Prison
Victim 12-17 (Offender 18+) 1st Degree Felony Up to 30 Years / Life (HTO/VCC rules)
No Physical Force/Injury 2nd Degree Felony Up to 15 Years Prison

Sexual Assault vs. Sexual Battery

People often use the terms sexual assault and sexual battery interchangeably. Sexual assault is no acualt crime in Florida defined as sexual assault. The term is colloquially used to refer to a number of sexually motivated crimes.

Florida law differentiates some sex crimes by the act of penetration or union:

  • Sexual Battery: Involves penetration or union with a sexual organ or object.

  • Battery (Sexual in Nature): If there was unwanted sexual touching (groping) without penetration or union, the State may charge this as Battery (F.S. § 784.03) or Lewd or Lascivious Molestation (F.S. § 800.04).

Strategic Defenses: Challenging the State’s Case

Because sexual battery cases often rely on "he-said, she-said" testimony rather than physical evidence, a skilled defense attorney can exploit the high burden of proof:

1. The "Consent" Defense

In cases involving adults, "intelligent, knowing, and voluntary consent" is a complete defense. Digital forensics (text messages, social media, GPS data) information can be used to show a pattern of consensual behavior that contradicts the accuser’s narrative.

2. DNA & Forensic Gaps

Just because DNA is present doesn't mean a crime was committed. Forensic experts can be used to challenge the timing, collection, and interpretation of "rape kit" evidence.

3. False Allegations & Motive

Unfortunately, sexual battery is a crime that can be falsely reported due to jealousy, revenge, or leverage in a high-stakes custody battle. A deep-dive investigation into the accuser’s background may uncover motives for fabrication.

4. "Physically Helpless" or "Incapacitated"

The State often argues the victim was too intoxicated to consent. Toxicology reports and witness statements can be used to prove that the individual was capable of making an "intelligent and knowing" decision.

Why Choose a Former Prosecutor for a Sex Crime Case?

Attorney Christopher J. Lewis previously built these cases for the State. He knows what prosecutors look for to decide which cases to file and which to drop.

  • Inside the SVU: I understand how law enforcement interviews witnesses in sex cases and where they may cross the line into "coercion."

  • Trials: If the State refuses to drop a charge based on weak evidence, Lewis Defense Law is prepared to hold them to their burden of proof in front of a Lake County jury.

  • Pre-File Intervention: The best time to win a sexual battery case is before it is filed. Attorney Lewis will move quickly to present any exculpatory evidence to the State Attorney’s Office in an attempt to prevent formal charges.
